Terms of Service

The service

TruckWisely is software for trucking companies to manage dispatch, equipment, drivers, safety records, accounting, and related work. We may improve, change, or retire features over time. Free trials are provided as-is and may end at the close of the trial period.

Your account

• Provide accurate information and keep your password secure. You are responsible for activity under your account and for the users you invite.
• When you claim a carrier by USDOT number, you must be authorized to act for that carrier.
• Tell us promptly at support@truckwisely.com if you suspect unauthorized access.

Your data

You own the records and files you put into TruckWisely. You give us permission to host, process, and display them only to provide and support the service, as described in our Privacy Policy. You are responsible for having the right to enter the information you store, including driver personal information, and for meeting any notice or consent requirements that apply to it. You can export your records while your account is active.

Compliance is your responsibility

TruckWisely helps organize records, track expirations, and prepare workpapers such as IFTA mileage summaries, but it does not provide legal, tax, or regulatory advice. Reminders, calculations, AI suggestions, and data imported from government sources or third parties can be incomplete, delayed, or wrong. You remain responsible for your compliance with FMCSA, DOT, IFTA, IRP, tax, employment, and other requirements, and for reviewing information before relying on it or filing it.

AI features

AI-assisted features suggest values from documents or text you provide. Suggestions are not verified and must be reviewed by you before they are saved. Do not submit content you are not allowed to share with our AI provider.

Acceptable use

You agree not to:

• access another company's data, or attempt to bypass security, permissions, or rate limits;
• upload malware or unlawful content, or use TruckWisely to send spam;
• reverse engineer, resell, or overload the service, except as the law allows;
• use TruckWisely in violation of any law or anyone else's rights.

Third-party services

Integrations such as Samsara, email delivery, and public FMCSA data are provided by third parties under their own terms. We are not responsible for their availability or accuracy.

Fees

Paid plans, if you choose one, are billed monthly in advance through our payment processor, Stripe, and renew automatically until you cancel. You can cancel at any time from Settings → Billing; access continues until the end of the month you paid for. When a free trial ends without a paid plan, your workspace becomes read-only and your data is kept. Fees are non-refundable except where required by law or stated otherwise in writing. We will give notice before changing the price of a plan you are on.

Suspension and termination

You may stop using TruckWisely at any time. We may suspend or end access if you breach these terms, fail to pay, or create a security or legal risk. After termination, we will make your data available for export for a reasonable period on request, then delete it as described in the Privacy Policy.

Disclaimers

TruckWisely is provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, and we do not promise the service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent allowed by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, or for fines or penalties. Our total liability for any claim relating to TruckWisely is limited to the amount you paid us in the 12 months before the claim.

Indemnity

You will defend and hold us harmless from claims arising from your data, your use of TruckWisely in violation of these terms or the law, or your users' actions.

Changes and contact

We may update these terms. We will post the new version here and update the effective date, and we will notify account owners of material changes. Continued use after a change means you accept it. Questions? Email support@truckwisely.com.
